Advocate Kanisth Manuja handles Supreme Court matters for clients whose cases have run their course in the Delhi High Court or the district courts below. It is worth being precise about how this works: Supreme Court matters are conducted by briefing and appearing alongside senior advocates as the Court’s rules and the nature of the matter require, rather than being presented as an independent Supreme Court practice. Clients are told at the outset who will argue their matter.
Matters taken to the Supreme Court
- Special leave petitions under Article 136 against orders of the High Court
- Criminal appeals, including appeals against conviction and against refusal of bail
- Civil appeals on substantial questions of law
- Writ petitions under Article 32 where fundamental rights are engaged
- Transfer petitions moving proceedings between States, common in matrimonial matters
- Review and curative petitions in appropriate cases
Special leave is discretionary
An SLP is not an appeal as of right. The Court is being asked to exercise a discretion, and it grants leave sparingly — typically where there is a substantial question of law of general importance, a conflict between High Courts, or a gross miscarriage of justice. A realistic assessment of whether a matter is genuinely of that character is more useful to a client than an optimistic one, because the cost of a Supreme Court filing is substantial and most petitions are dismissed at the threshold.
Limitation
An SLP is ordinarily to be filed within 90 days of the High Court’s judgment, or 60 days from refusal of a certificate of fitness. Delay can be condoned on sufficient cause, but the certified copy should be applied for as soon as the order is passed.
What preparation involves
Most of the work in a Supreme Court matter happens before the hearing: assembling the record from the courts below, settling the questions of law with senior counsel, preparing the synopsis and list of dates, and reducing the case to the narrow points on which leave might realistically be granted.
Frequently Asked Questions
Do you argue matters in the Supreme Court yourself?
Supreme Court matters are prepared and conducted with senior advocates engaged for the hearing, in the manner the Court’s rules and the matter require. You will be told who is appearing before the matter is filed.
How long does an SLP take to be listed?
Listing for admission is usually within weeks of filing. If leave is granted and the matter is converted into an appeal, final hearing can take considerably longer.
Is an SLP worth filing in every case?
No. Leave is granted in a small proportion of petitions, and an honest assessment of prospects should be made before incurring the cost.
